Terms and conditions

General terms of engagement and of the commercial license of use of the digital stationery designs. They complement the explanation on the The process page.

1. Scope

These conditions govern the engagement of digital stationery design services provided by Elisa Peteiro Pérez (NIF 34962212G, Avda. Portugal 63, 32002 Ourense (Spain)), hereinafter “the designer”, and the license of use of the designs, hereinafter “the license”.

The services are aimed at companies and professionals (hotels, resorts, jewelers, event companies, brands and similar). By accepting a quote, the client declares that they are contracting within the scope of their professional activity.

In the event of a difference between these conditions and the license document or the quote accepted for a specific project, the latter will prevail.

2. Services

Prices are not published on the website. Each project is quoted individually.

3. Quote and engagement

The client requests a quote by email or WhatsApp, indicating the type of project, the style, the sizes and the number of designs needed. The designer will send the quote and, together with it, the license document.

The contract is considered formalized when the client accepts the quote and makes the first payment. From that moment the project is reserved in the work schedule.

5. Delivery

All products are exclusively digital. Each design is delivered as a PDF (prepared in CMYK for professional printing) and as a PNG, in high resolution and in the requested sizes, with a separate file for each design.

Delivery is made via WeTransfer. Editable files or source files (Illustrator, Photoshop or other working formats) are not delivered.

Timelines are estimates and depend on the complexity, the number of designs and sizes, the workload and how quickly the client provides materials, decisions and approvals. The designer keeps a backup copy of each project.

6. Revisions and changes

During the creative process the designer may send sketches for review. Adjustments needed within the process are included as indicated in the quote. The design is not considered finished until the client approves the result.

Once the final design has been delivered and approved, any later modification (new sizes or formats, changes of color, flowers or elements, composition or others) will have an additional cost, which will be communicated before the work is done. Mistakes made by the designer are corrected at no cost.

7. License of use

Purchasing a design or collection does not transfer its intellectual property. The designer retains all copyright; the client acquires a commercial license of use, tied to the company that engages her and non-transferable, with the scope and limits set out in these conditions and in the license document.

8. Uses not permitted

Breach of these conditions, including use at religious events or with a Christmas theme, may result in immediate cancellation of the license and the end of all authorized uses. The client must stop using the design and remove it from the products, media or channels in which it is being used, without prejudice to any other actions available to the designer.

9. Exclusivity

Non-exclusive catalog collections may be licensed to other companies. The client may request exclusivity by city, state, country, a set period of time or permanently, under the conditions and at the cost agreed in the quote.

Temporary exclusivity ends when the agreed period ends, unless renewed. Permanent exclusivity means the design will not be licensed to third parties again. Exclusivity does not by itself imply a transfer of copyright.

10. The designer’s signature

Catalog designs include the designer’s signature, discreetly integrated. The client may request that their brand appear instead, at an additional cost for the change in the attribution of authorship and the corresponding authorizations.

11. Cancellations

If the client cancels a project once it has started, the conditions agreed in the quote and in these conditions will apply, taking into account the work already done. For exclusive designs, the work already done may be subject to the cancellation conditions agreed.

As these are services aimed at professionals, the right of withdrawal granted to consumers does not apply. If, exceptionally, the client were a consumer, please note that, under article 103 of the Spanish consolidated text of the General Law for the Defense of Consumers and Users, there is no right of withdrawal for the supply of goods made to the consumer’s specifications or clearly personalized, nor for digital content whose performance has begun with the consumer’s consent.

12. Liability

The colors of the files may vary between screen and print, depending on the printer, the paper and the supplier’s settings. The designer is not responsible for printing results or for any use the client makes of the designs contrary to these conditions.

To the maximum extent permitted by law, the designer’s liability is limited to the amount actually paid for the specific project giving rise to the claim.

The staging images on the website are examples created with artificial intelligence tools and are not part of what is delivered.

13. Data protection

The processing of the client’s personal data is governed by the Privacy policy.

14. Applicable law and jurisdiction

These conditions are governed by Spanish law. The parties submit to the courts and tribunals of Ourense, waiving any other jurisdiction, unless the applicable regulations assign another mandatory jurisdiction.

15. Changes

The designer may update these conditions. Each project is subject to the conditions in force on the date the quote is accepted.
